O Metrô foi autuado, dia 13.06.2014,
pela Superintendência Regional do Trabalho e Emprego por atitude
anti- sindical devido à demissão de trabalhadores em meio à Greve da
categoria na semana passada.
“O Metrô tinha meios jurídicos para fazer valer a decisão do Tribunal Regional do Trabalho. Mandar embora 42 trabalhadores sem nem dizer qual a justa causa que está sendo alegada é abuso de direitos'', afirmou Renato Bignami, auditor fiscal do trabalho responsável pelo caso. “Uma greve é conflitiva por natureza. Não é correto a empresa se valer de seu poder hierárquico e mandar embora 42 trabalhadores diretamente envolvidos na greve. Isso é aviltar os direitos dos trabalhadores'', explica.
Através de sua assessoria de comunicação, o Metrô de São Paulo informou que “as demissões não se basearam no ato de greve, mas em razão de abusos cometidos durante o período de greve''.
O auto de infração afirma que a dispensa por justa causa de 42 trabalhadores, alguns dos quais dirigentes sindicais, “adquire contornos de desproporcionalidade, notadamente tendo em vista a decisão judicial editada em favor da empresa''.
O impacto financeiro é mínimo dado que o valor da autuação é baixo (R$ 8.050.55) e, além disso, cabe recurso. Contudo, ela significa que o Ministério do Trabalho e Emprego vê as demissões de trabalhadores durante a greve como abusivas. Ou seja, isso ajuda a reabrir a discussão sobre a legitimidade das demissões do Metrô e contribui com o argumento da defesa dos trabalhadores.
“O ato terminativo dos 42 contratos de trabalho por justa causa dos empregados acabou, assim, aparentando uma medida de caráter persecutório que poderia possuir o condão da vingança ou perseguição à categoria, incabíveis neste momento de conflito.'' Segundo o auto, a empresa contraria convenções da Organização Internacional do Trabalho, atentando contra a liberdade sindical.
