Ministério Público abre inquérito para apurar Morte em Obra da Linha 17-Ouro/Prosecutor opens investigation into Death at Work Line 17-Gold

O Ministério Público do Trabalho em São Paulo informou dia 11.06.2014 que instaurou inquérito civil para apurar a morte do operário Juraci Cunha provocada pela queda de uma viga em obra do monotrilho.

O Metrô disse que vai colaborar com o Ministério Público do Trabalho para obter os esclarecimentos necessários. O Consórcio Monotrilho Integração informou que está colaborando com as investigações das autoridades em relação ao acidente e ressaltou que quer esclarecer de forma transparente e o mais rápido possível as causas do ocorrido

No inquérito, o Consórcio Monotrilho Integração (formado por Construtora Andrade Gutierrez SA, Cr Almeida SA Engenharia De Obras, Scomi Engineering BHD e MPE Montagens e Projetos Especiais SA) deverá responder se houve desrespeito às normas de proteção ao trabalhador.

De acordo com o MPT, os fatos relatados, caso comprovados, importam em grave lesão aos interesses metaindividuais dos trabalhadores, pois tratam-se de violações aos princípios de proteção ao trabalho, sobretudo ao direito ao meio ambiente seguro.

A procuradora do trabalho que conduz o caso, Andréa Albertinase, já estabeleceu contatos com da Defesa Civil, Delegacia de Polícia e Corpo de Bombeiros para recebimento dos laudos técnicos periciais que estão sendo elaborados pelas instituições, e com o Ministério do Trabalho e Emprego para recebimento dos autos de infração referentes ao acidente.

Também oficiou o Consórcio para que, em 10 dias, apresente documentos relativos aos cuidados exigidos em trabalhos em altura como análise de risco e permissões de trabalho, controle médico, treinamentos e capacitações realizados, entre outros.

A procuradora intimou o Metrô para que se manifeste sobre as medidas adotadas e solicitadas as representantes do Consórcio no que se refere a prevenção de acidentes de trabalho e, especificamente, quanto ao acidente do dia 09.06.2014, considerando-se sua responsabilidade legal na execução do contrato e verificação do cumprimento das normas relativas ao meio ambiente de trabalho.

O Consórcio informou também que está prestando total suporte aos familiares do colaborador Juraci Cunha dos Santos, vítima fatal do acidente, e aos dois colaboradores feridos, que não correm risco de morte. O Consórcio reiterou que a obra é executada dentro dos mais rígidos padrões de segurança internacionais​ e que aguarda a conclusão da perícia. Por último, o Consórcio Monotrilho Integração esclareceu que a operação de ajustes de vigas realizadas em 09/06 já tinha sido repetida mais de 270 vezes sem qualquer tipo de incidente.

According to MPT, the reported facts, if proven, result in serious injury to workers metaindividual interests because these are violations of the principles of protection of labor, especially the right to a safe environment.
The prosecutor's work leading the case, Andrea Albertinase already established contacts with Civil Defence, Police Department and Fire Department for receiving the expert technical reports being prepared by the institutions, and with the Ministry of Labour and Employment for receiving notices of infraction relating to the accident.
Also officiated the Consortium so that in 10 days, provide documents relating to the care required to work at height as risk analysis and work permits, medical control and the training undertaken, among others.
The prosecutor ordered Metro to manifest on the measures adopted and requested the representatives of the Consortium regarding the prevention of occupational accidents and specifically about the accident of the day 09.06.2014, considering their legal responsibility in implementing the contract and verification of compliance relating to the working environment.
The Consortium also announced it is providing full support to the relatives of the employee Juraci Cunha dos Santos, a fatal victim of the accident, and the two injured employees, who are not at risk of death. The Consortium reiterated that the work is performed within the strictest international safety standards and is awaiting the conclusion of expertise. Finally, the Monorail Integration Consortium stated that the operation settings beams performed in 09/06 had been repeated more than 270 times without any incident.
